well, as it seems: when you make a new game out of the old game's engine, it's still considered modding. And if you change the name it becomes an 'unofficial game' and shouldn't have any problems with the license. As for the whole storyline: we need to make up some places that you have to visit to get to the end and then add optional quests and maps... The starting quests for each allignement is always easy(mostly talking to someone) then they lead to some other area wich you have to visit and so on...
"...shouldn't have any problems with the license." When dealing with legal questions, especially with huge corporations like Atari and Wizards of the Coast, that kind of assumption can cost my kids their college funds.
I'm writing a story which can be turned into a mod, once I've writen it I'm going to send it to the other main modders and ask if anything that happens in it couldn't be modded into the game.
